border-box;">为贯彻落实《中共中央 国务院关于促进民营经济发展壮大的意见》（中发〔2023〕15号）精神和《中共重庆市委 重庆市人民政府关于促进民营经济高质量发展的实施意见》（渝委发〔2023〕10号）要求，深入贯彻市委六届二次、三次全会和推动民营经济高质量发展大会精神，充分发挥政法机关法治保障和服务职能，依法平等保护民营企业合法权益，营造法治化营商环境，推动民营企业高质量发展，制定如下举措。</p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;"><br style="box-sizing: border-box;"/></p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;"><strong style="box-sizing: border-box;">一、严厉打击涉企违法犯罪活动。</strong>常态化开展扫黑除恶斗争，依法打击盗窃、敲诈勒索、故意毁坏财物等侵害企业合法权益的违法犯罪；突出惩治寻衅滋事、恶意阻工、暴力讨债等扰乱企业生产经营秩序的违法犯罪；依法严惩合同诈骗、串通招投标、强迫交易等扰乱市场经济秩序的违法犯罪。加强对园区、企业周边治安巡逻，综合运用人防物防技防措施实现动态防控。</p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;"><br style="box-sizing: border-box;"/></p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;"><strong style="box-sizing: border-box;">二、防止利用刑事手段干预经济纠纷。</strong>严格涉企经济犯罪案件立案审查，常态开展立案执法巡查。对涉企新型犯罪案件以及其他重大疑难复杂或者跨区域经济犯罪案件提级管辖。对国家重点扶持的高新技术类重点企业，在全国或全市有影响的产业龙头、就业大户、战略性新兴产业等重点企业财产采取强制措施的，报上级公安机关批准。</p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;"><br style="box-sizing: border-box;"/></p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;"><strong style="box-sizing: border-box;">三、减少查封扣押冻结措施对企业的影响。</strong>严格规范涉产权强制性措施，坚决防止超权限、超范围、超数额、超时限查封扣押冻结财产。对已经查封扣押冻结的，及时进行审查，确与案件无关的，迅速解除有关措施。对不宜查封扣押冻结的经营性涉案财物，在保证司法活动正常进行并采取必要的保值保管措施的同时，可以允许有关当事人继续合理使用。</p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;"><br style="box-sizing: border-box;"/></p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;"><strong style="box-sizing: border-box;">四、帮助企业依法合规经营。</strong>规范公司职务犯罪立案，依法加大对民营企业工作人员职务侵占、挪用资金、商业贿赂等腐败行为的惩处力度。深入推进涉案企业合规改革试点，督促符合条件的涉案企业作出合规承诺、切实加以整改，提升企业规范化管理水平。定期发布保护民营企业典型案例，开展“法治讲坛”“警示课堂”，及时提供法律咨询，提高企业人员遵纪守法意识。</p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;"><br style="box-sizing: border-box;"/></p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;"><strong style="box-sizing: border-box;">五、加大对企业知识产权司法保护力度。</strong>充分发挥知识产权司法裁判职能，有效运用速裁快审和多元化纠纷解决机制，依法适用小额诉讼程序等简易程序，对简单知识产权侵权案件适用要素式审理，采用简式裁判文书，缩短案件办理周期、降低解纷成本。建立涉知识产权行政非诉审查快审机制，在企业明确表示无需听证时，直接书面审查行政行为的合法性，对行政行为不合法的，依法裁定不予执行。</p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;"><br style="box-sizing: border-box;"/></p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;"><strong style="box-sizing: border-box;">六、防止对企业任意性、选择性执法。</strong>充分发挥司法行政机关监督行政执法职能作用，推动市级执法部门普遍制定或修改行政处罚裁量基准。推行告知、提醒、劝导等执法方式，对初次违法且危害后果轻微并及时改正的依法不予行政处罚。针对涉企行政争议，实行涉企案件繁简分流，探索推广“掌上复议”网上申请，通过开辟涉企应用板块，畅通企业申请行政复议渠道，提升企业行政复议事项办理效率。</p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;"><br style="box-sizing: border-box;"/></p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;"><strong style="box-sizing: border-box;">七、高效化解涉企劳动争议纠纷。</strong>司法行政部门针对追索劳动报酬、确认劳动关系、工伤保险待遇纠纷等多发劳动争议，加强纠纷调解力度。法院建立劳动仲裁与审判裁审衔接、信息共享机制，推进劳动争议诉前化解，降低企业劳动争议化解成本。法院会同检察院、人力社保局等单位定期研讨、统一发布劳动争议案件的裁判规则和标准，定期发布劳动争议典型案例。</p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;"><br style="box-sizing: border-box;"/></p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;"><strong style="box-sizing: border-box;">八、推动涉企法治服务“一件事一次办”。</strong>深化“警快办”建设应用，开设警企联系“我来帮你”专栏，推出更多“扫码办”“零材料办”，逐步推动全程网办率达80%以上。开通检察机关涉企事项办理“绿色通道”，实现电话办、网上办、视频办。法院系统对全流程诉讼服务事项实行“一网通办”，推动企业办事“最多跑一次”“一次不用跑”。加快开发数字执行应用，有效解决涉企执行难问题。</p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;"><br style="box-sizing: border-box;"/></p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;"><strong style="box-sizing: border-box;">九、为企业“走出去”提供国际化法律服务。</strong>建立涉外公共法律服务平台，提供线上线下法律咨询、开展疑难问题法律会诊、编写涉外投资指引、发布跨境投资贸易风险预警，防范化解涉外法律风险。扎实推进西部金融中央法务区建设，组建高水平涉外律师服务团队。发挥“重庆国际商事一站式多元解纷中心”作用，提供调解、仲裁、公证、诉讼等全链条对接服务，帮助民营企业多元、便捷化解涉外商事纠纷。加快建设中国区域性国际化仲裁中心，便利企业就近、高效解决争议。</p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;"><br style="box-sizing: border-box;"/></p><p style="white-space: normal;margin: 0px;padding: 0px;box-sizing: border-box;"><strong style="box-sizing: border-box;">十、畅通涉企不规范司法行为反映渠道。</strong>及时研判分析、流转办理12337涉企举报线索。充分发挥法院12368、检察机关12309、公安机关12389和司法行政机关12348等热线作用，全天候受理企业诉求，7个工作日内作出回应答复。党委政法委组织专业力量，针对企业反映的案件，依法依规开展案件评查、案件督办，切实规范涉企案件办理；针对企业反映强烈的信访诉求和司法突出问题，开展常态化执法检查，规范司法行为，降低对企业正常生产经营活动的影响。</p><p border-box;">十一、组织开展企业对政法机关的满意度测评。</strong>建立政法机关服务保障民营经济满意度测评工作机制，通过第三方调查的方式，围绕涉企案件办理质效，涉企矛盾纠纷是否及时排查化解，政务审批是否便捷高效，法律服务是否精准有效等方面开展测评，全面科学客观评价政法机关服务保障民营经济工作成效。</p></section></section><section
